By Farley Tolpen, CEO. I estimate that I have mediated around 3,000 matters with about 65% involving lawyers and their clients. Approximately 90% of mediations with lawyers involved have resolved. I recently conducted a mediation in which there was a history of litigation and acrimony between the parties. The lawyers had also issues between them. The matter was set for trial approximately one month after the mediation. The pre-mediation telephone conferences lasted over an hour for each of the lawyers and parties. The mediation itself lasted 7 hours. Both lawyers were instrumental in working toward the goal of a full resolution. They worked with each other and their clients to reach agreement. They were proactive and among other things, reality tested with their clients when necessary. The parties reached full agreement and I prepared the settlement papers at the mediation. The parties were happy and the lawyers were satisfied with a job well done. I enjoyed managing the process and assisting the parties with their lawyers in resolving their differences.
